The trial detailed in the previous two posts took three days.
When they jury returned, they awarded my client the following:
- $21,000 for medical expenses,
- $8,480 for lost wages,
- No Impaired Earning Capacity, which was not a total surprise, given that my client testified that he felt he could do the same work as before and just had to be more careful,
- $10,000 for non-economic damages, which was also not a complete surprise since my client could point to very little differences in his physical activity attributed to his shoulder.
The offer going in was $5,000, plus PIP (approximately $15,000), so the award of almost $40,000 was a big win for our client.
